SereneFlow Terms of Service

These Terms of Service ("Terms") are an agreement between you and SereneGuard ("SereneGuard", "we", "us", or "our"), the operator of SereneFlow. By creating an account or using SereneFlow (the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you download SereneFlow through the Apple App Store, Apple's Standard Licensed Application End User License Agreement also applies unless a valid custom EULA is presented through the App Store.

1 — Fitness and wellness service

SereneFlow provides guided pelvic-floor exercise and general postpartum fitness and wellness information. It is not a medical device or healthcare service, and it does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning an exercise program if you have questions about your health — especially if you are less than six weeks postpartum, have not been cleared to exercise, experience pelvic pain, or have a condition that may affect exercise. Stop exercising and seek appropriate care if you experience pain, pressure, heaviness, bleeding, dizziness, shortness of breath, or other concerning symptoms.

2 — Eligibility

You must be at least 18 years old and legally able to enter into these Terms. By creating an account, you represent that you meet these requirements.

3 — Your account

You must provide accurate information, keep your credentials confidential, and promptly update information that changes. You are responsible for activity under your account except to the extent caused by our failure to use reasonable security. Notify us promptly at service@thesereneguard.com if you suspect unauthorized access.

4 — Limited license and acceptable use

Subject to these Terms, SereneGuard grants you a personal, limited, revocable, non-exclusive, non-transferable license to use SereneFlow for your own lawful, non-commercial fitness and wellness purposes.

You may not misuse the Service; interfere with its operation or security; access it through unauthorized automated means; scrape or reproduce protected content; reverse-engineer the Service except where law expressly permits; impersonate another person; violate another person's rights; or use the Service to harass, threaten, exploit, or deceive others.

5 — Community content

You retain ownership of content you submit. By posting, you grant SereneGuard a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, distribute, and moderate that content solely as reasonably necessary to operate, secure, and improve the Service. This license ends when the content is deleted from our active systems, except for limited protected backups, legal obligations, and content that must temporarily remain to preserve the integrity of a shared discussion.

We have zero tolerance for objectionable content or abusive behavior, including harassment, hate, threats, sexualized content, spam, impersonation, exploitation, illegal content, and medical misinformation presented as fact. You may report content and block users directly in the Service. We review reports and act promptly where content violates these Terms. Content may be hidden automatically while awaiting review. We may remove content, limit features, or suspend or terminate accounts when reasonably necessary to protect users or the Service.

Community content reflects users' personal experiences and is not verified medical advice. Do not rely on it for diagnosis or treatment.

6 — Third-party content

Some educational material is produced by independent authors and included with attribution. Third-party names and content remain the property of their respective owners. Links or references to third parties do not constitute an endorsement, and third-party services are governed by their own terms and privacy policies.

7 — Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information, including fitness and wellness information that may qualify as consumer health data under certain laws.

8 — Termination

You may stop using SereneFlow or initiate account deletion at any time through Profile → Delete account. The scope and timing of deletion are described in our Privacy Policy. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk for other users, or threaten the security or lawful operation of the Service. Where appropriate, you may contact us to request review of an enforcement decision.

9 — Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee that it will be uninterrupted, error-free, or suitable for every person or recovery stage. Exercise involves inherent risk, and you are responsible for using reasonable judgment and following professional advice applicable to you.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10 — Limitation of liability

To the fullest extent permitted by law, SereneGuard will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from the Service. These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation.

11 — Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except where the mandatory consumer-protection laws of your place of residence apply. Any court proceeding must be brought in a court with lawful jurisdiction.

12 — Changes

We may update these Terms as the Service changes. We will post the revised Terms with a new effective date and provide additional notice before material changes when required by law. Your continued use after the effective date constitutes acceptance to the extent permitted by law.

13 — General

If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, or sale of the Service, subject to applicable privacy obligations. These Terms and the Privacy Policy form the entire agreement regarding your use of SereneFlow, together with any mandatory App Store terms.
